1. The Civil Procedure Code -LRB- Section 115 -RRB- provides that the High Court may call for the record of any case which has been decided by any court subordinate to the High Court and in which no appeal lies thereto and if such subordinate court appears :

2. It may , on its own motion or otherwise , call for records of any proceedings before the adjudicating officer for the purpose of examining the legality , propriety or correctness of any order made by the Adjudicating Officer and make such order as it thinks fit .
   यह स्वप्रेरणा से अथवा अन्यथा , न्यायनिर्णायक अधिकारी के किसी आदेश Zकी वैधता , औचित्य अथवा शुद्धता की जांच करने के लिए न्यायनिर्णायक अधिकारी के समक्ष हुई किन्हीं कार्रवाइयों का अभिलेख मंगा सकता है और ऐसा आदेश पारित कर सकता है जो वह ठीक समझे .

Where any High Court is satisfied that a case pending in the lower courts involves a substantial question of law as to the interpretation of the Constitution , it may withdraw the case and either itself decide it or determine the said question of law and return the case to the Court for determination -LRB- article 228 -RRB- .
   यदि किसी उच्च न्यायालय का यह समाधान हो जाए कि किसी निम्नतर न्यायालय में लंबित किसी मामले में संविधान के निर्वचन से संबंधित कोई सारवान प्रश्न अंतर्ग्रस्त है तो वह मामले को अपने पास मंगा सकता है और या तो वह मामले को स्वयं निपटा सकेगा या उक्त विधि के प्रश्न का अवधारण कर सकेगा और मामले को अवधारणा के लिए न्यायालय को लौटा सकेगा ( अनुच्छेद 228 ) .
